MP HC: Marriage or Divorce Cannot Be Performed Through a Notarised Agreement

The Madhya Pradesh High Court has clarified that neither marriage nor divorce can be legally effected through a notarised agreement under Hindu law. The Court held that the deceased employees first marriage continued to subsist because no valid divorce decree had been obtained. It also observed that marriage under Hindu law is not a contract that can be created through a notarised agreement. As a result, the claimant was denied family pension and related benefits.
