A Transfer by Personal Representative to Purchaser (Form LRA 43) is an official document used in Kenya when an executor or administrator sells estate property to a third-party buyer rather than transferring it to beneficiaries. This jurisdiction-specific form is prescribed under the Land Registration Act and the Land Registration (General) Regulations, 2017, specifically Rule 58(1). It enables personal representatives to convert estate property into cash for debt settlement, expense payment, or distribution among beneficiaries according to court orders or estate requirements.
This form is intended for executors, administrators, estate trustees, property buyers, investors, developers, and their legal representatives involved in estate property sales. Personal representatives may need to sell estate property to pay debts, settle taxes, cover funeral and administration expenses, liquidate assets for easier distribution, or comply with will provisions directing property sale. Unlike Form LRA 42 which transfers to beneficiaries, this form transfers to purchasers who pay market value for the property.
The form requires the title number, date, name of the deceased proprietor, date of Grant of Will or Letters of Administration, date of confirmation, names of the transferor(s) as personal representative(s) of the deceased's estate, and names of the transferee(s) identified as purchaser(s). The consideration section must specify the purchase price paid, making this a commercial transaction rather than inheritance distribution. If multiple purchasers buy jointly, they must declare whether they will hold as joint proprietors or proprietors in common with specified shares.
Both the personal representative (transferor) and the purchaser(s) (transferees) must execute the transfer with colored photographs, identification or passport numbers, PIN numbers, and signatures verified by certifying officers under Section 45 of the Land Registration Act. Once registered and sealed by the Land Registrar, ownership passes to the purchaser(s), converting estate property to cash that the personal representative can use for estate administration and distribution to beneficiaries within Kenya's succession and land registration framework.
